Ohio Democratic Party Files 8th Public Records Request For Treasurer's Office Staff Resumes

 

COLUMBUS, OHIO – Today, in an attempt to determine once and for all just how deep cronyism runs in the Treasurer's office under Josh Mandel, the Ohio Democratic Party (ODP) filed its eighth public records requestwith the Ohio Treasurer’s office for resumes of office staffers Mandel  has hired.
 
The eighth request since April 2011 followed yet another incomplete response from the Treasurer's office sent last week, which was still missing the resumes for 34 staffers Mandel hired – nearly half of his total office hires. Unbelievably, this response came just days after Mandel arrogantly declared the fact he is deliberately hiding the resumes and qualifications of staffers he has hired was "blatantly wrong and simply false."
 
In response to ODP's seven previous requests the Treasurer's office sent incomplete and unnecessary information, or has yet to respond.

This is our eighth letter and public records request for public information on employees at the Treasurer’s office.  Apparently, you as General Counsel, or the Office of the Treasurer of State as a whole are either incompetent or are in willful non-compliance with our very basic public records request.  I do not delight in making such a statement – I just don’t know what else to call it when we’ve had to send eight letters that have spanned over a year and you have been unable or unwilling to comply with such a basic request. 
 
We have tried to be clear, and we have been more than patient.  I would stop by the Treasurer’s office and draw a picture for you if I thought it would help.  But instead, I will, for the eighth time, request documents that you either have in your office and have deliberately not provided to us or that you do not have in your office and are simply too embarrassed to admit do not exist.
 
We have done the “grunt work” and included in our last two public records requests the specific names of the employees whose resumes we are requesting. But you and the Treasurer’s office have withheld “approximately” 34 resumes or have been unwilling to put in writing that the resumes for those employees are not in the office’s records. 
 
"Josh Mandel must come clean by directly stating whether he is deliberately hiding the resumes and qualifications of Treasurer's office staffers he hired, or if he instead carelessly awarded taxpayer-funded salaries to 34 employees without ever seeing their resumes or conducting formal interviews," said Ohio Democratic Party spokesman Andrew Zucker. "Until Josh finally discloses the resumes and qualifications for the staffers he's hired at taxpayer expense, or explains why he's unable to do so, Ohioans are left wondering just how deep cronyism runs in the Treasurer's office under Mandel, who continues to prove he's just another politician who can't be trusted."

Dear Mr. Metcalf:
 
This is our eighth letter and public records request for public information on employees at the Treasurer’s office.  Apparently, you as General Counsel, or the Office of the Treasurer of State as a whole are either incompetent or are in willful non-compliance with our very basic public records request.  I do not delight in making such a statement – I just don’t know what else to call it when we’ve had to send eight letters that have spanned over a year and you have been unable or unwilling to comply with such a basic request.

I can’t help but notice that your name is one of the resumes that we have requested multiple times yet it has not been included in correspondence from the Treasurer’s office.  What does it say when the General Counsel and Chief Financial Officer of the Treasurer’s office repeatedly responds to public requests, which include a request for his resume, yet does not feel compelled to include his resume?  It seems to me that attorney would be either one of the most incompetent attorneys working for the State of Ohio or an attorney set on deliberately violating Ohio law.
 
But I’m going to cut you some slack, Mr. Metcalf.  I know that because Mr. Mandel is rarely in the office and often fundraising for his Senate campaign in places like Hawaii, the Bahamas and Washington, D.C., your time must be a precious commodity.  So I’ll give you another chance to comply with a request so simple it could have probably been done in an hour or two, especially since you have purported to have fully complied with the requests before. 
 
The resumes are either there, or they aren’t. 
 
I would like to make three things very clear (even though we’ve made them clear several times before). 
 
1.      We are only asking for the resumes of the employees listed below.
2.      We do not want any resumes of people not listed below
3.      If you do not have the resumes of the employees listed below, please note in your correspondence those employees whose resumes are not on file at the Treasurer’s office.
 
You seem to have been confused by these three points in your past responses to our requests so I will repeat them:
 
1.      We are only asking for the resumes of the employees listed below.
2.      We do not want any resumes of people not listed below
3.      If you do not have the resumes of the employees listed below, please note in your correspondence those employees whose resumes are not on file at the Treasurer’s office.
 
Below is a plain English version of what we are requesting (in case you were confused by the statute we’ve cited seven times before).

**SAME OHIO PUBLIC RECORDS REQUEST BELOW – PLEASE PAY ATTENTION TO THIS PART**
 
This is a request pursuant to Ohio Revised Code § 149.43 for the following specific records:
 
1.      All records, including without limitation documents and communications whether stored electronically or in hard copy, relating to the resumes and/or cover letters of the specific employees listed below who are or were employees of the Office of the Ohio Treasurer of State between January 10, 2011 and May 3, 2012.  If resumes and/or cover letters were not requested by the Treasurer’s office and are not on file, please note which individual employees do not have such records on file at the Treasurer’s office.

Please produce the requested records within a reasonable period of time.  We anticipate that many of these records will be easy for your office to produce since we have been requesting these specific records for over a year, and we request that you produce them on a rolling basis as you are able to copy or otherwise reproduce them.  We do not wish to wait until you have gathered all of the requested records before you produce them.  Please let me know when you anticipate producing records.
 
If there is any information that will be excluded or any materials that will be redacted (other than Social Security numbers) pertaining to our request, we want to know those categories and under what privacy law or other provisions they are withheld or redacted. 
 
Should any portion of this request be denied, in part or in whole, the law requires written justification for its denial, along with a citation of the appropriate Open Records Act exemption that applies for each record, or portion thereof, that is withheld or redacted.
